Senior Magistrate Will Francis said he did not have sufficient powers to sentence Heman Viera, who has a long list of previous convictions.

He remanded the 29-year-old in custody for sentencing.

As he left Magistrates' Court, Viera told Mr. Francis: "You can take me away but I will be released.'' The court heard Viera, of Khyber Pass, Warwick, had only just completed a jail term before the offence.

Prosecutor Sgt. Anthony Mouchette said Viera took money from taxi driver Beutin Bailey's pocket on September 10 after taking a ride with him.

Earlier, Mr. Bailey had taken Viera around Warwick, including Westmount Lane and Spice Hill Road.

Mr. Mouchette said Viera claimed later he had stolen only $13.

He added Viera, who admitted the charge, demonstrated a complete lack of respect for the sentencing powers of the court.

Mr. Francis said: "Having seen and heard this defendant I am convinced that my sentencing powers are insufficient. Therefore I remand him in custody for sentencing by the Supreme Court.'' Agriculture and Fisheries assistant director Kevin Monkman said that Government trainee Veterinary Officer Dr. Susann Smith was presently preparing for the position.

He said it was hoped that she would become qualified and take on the position but the appointment would have to go through the proper channels including the Public Services Commission.

Dr. Burnie finished working at the department on Wednesday and is presently off the Island enjoying a brief vacation before starting work at Endsmeet Animal Hospital in Devonshire.
