But it is still unclear if the complainant, 1998 International Race Week 10K winner Charles Mulinga of Zambia, will be in Bermuda to testify.
Yesterday Junior Crown counsel Veronica Gordon told Magistrate Edward King the Attorney General's chambers would proceed with charges against Sean Reginald Tucker of Broken Hill, Smith's Parish. The 33-year-old is accused of causing grievous bodily harm to visiting race competitor Mr. Mulinga on January 19 last year.
The trial has already been adjourned twice, and Ms Gordon admitted she had "no information whether or not the complainant will be able to appear at all''.
Tucker, who was unrepresented yesterday, is next scheduled to appear on April 19.
