agree on legal costs following their marathon battle over Perot's Island, a court heard yesterday.

Mrs. MacMillan was taken to court by Mr. DeGroote after changing her mind about selling the island to him for $8.5 million. Mr. DeGroote won the case two months ago after a 30-day trial.

Supreme Court judge the Hon. Mr. Justice Ground decided Mr. DeGroote should get the island, and dismissed claims from Mrs. MacMillan of misconduct by real estate firms Betco and Coopers.

After the trial her opponents' legal bills were said to total more than $400,000. Yesterday Mr. John Riihiluoma, for Mr. DeGroote, told the judge Mrs.

MacMillan's lawyers had reached an agreement on costs with lawyers for Coopers.

But her lawyers had not reached agreement with himself or with Betco's lawyers, and a hearing would be needed to argue the question.

Mr. DeGroote was represented in the trial by Mr. Riihiluoma, Betco by Mr. Mark Diel and Ms Clare Hatcher, and Coopers by Mr. Andrew Martin. Mrs. MacMillan's lawyers were Mr. Julian Hall and Mr. Robin McMillan.

Mrs. MacMillan is appealing the trial result.
