Dr. James Burnett-Herkes, 56, who quit his $107,000-a-year post as Permanent Secretary to the Department of the Environment last year, took the Public Service Commission to court after it failed to include part of his period of public service in his pension package.

Dr. Burnett-Herkes began working for the Ministry of the Environment in 1962 and was promoted to a pensionable post four years later.

When the Public Services Commission calculated his pension just before his retirement the first four years of his service were not included in the package.

But yesterday Puisne Judge Richard Ground ruled that, because Dr.

Burnett-Herkes' first position had since become a pensionable post, the Public Service Commission should have at least considered it when calculating the doctor's pension.

The Commission will now have to re-examine the pension, taking into account the special circumstances of Dr. Burnett-Herkes' claim, before forwarding it to the Governor for approval.
