more than $4,000 and firing shots from a semi-automatic pistol was found not guilty on both charges.

Jerry Eugene Fubler, of High Point Lane, was told by Puisne Judge the Hon. Mr.

Justice Ground that he was free to go after spending more than a year in prison.

Ten members of the seven-women, five-man jury agreed Fubler was not guilty.

Last June, Fubler was said to have robbed security guard Warren Foggo, 74, outside the Bermuda Telephone Company's St. George's branch and fire a pistol.

The court heard how Sandra Washington, a cashier at the Telco office had put the day's takings in a Bank of N.T. Butterfield deposit bag for Foggo to collect.

As the security guard returned to his vehicle with the bag, a masked man shot across Foggo's chest and grabbed the deposit bag.

Mr. Philip Storr, lawyer for the prosecution, added that bullets were found in the front passenger seat and side pocket of the driver's side door.

"I had the bag in my right hand, and all of a sudden I noticed someone running toward me. He was wearing a woollen cap over his head,'' Foggo testified.

He added: "I heard a bang, and I looked up to see that he had a short- muzzled gun in his hand. I fell back in my seat and he gripped the bag from me and ran.'' While being investigated Fubler admitted to Police he stole the money and fired shots from the gun.

But two days later he told Police his confession was false, and he had only made it because he didn't want "his mates to go down for something they didn't do.'' He added his guilty confession was based on what he read in The Royal Gazette the day following the robbery.
