The proposed development at High Point Road violated acts pertaining to the protection of beaches and the habitat according to the Development Applications Board.

"The proposed development is a forbidden act,'' the DAB said.

The board considered the proposal by J. Henry Dallas covering 13,000 square feet did not "preserve all significant natural features and vegetation''.

"Its visual impact is not minimal,'' the DAB said.

And it said the sea wall was not required for safety reasons or to provide protection against wave damage.

The board also objected to the height of the docks which exceeded 16 feet.

"It would not blend in with the natural appearance of the foreshore.''
