Sleeping driver was in control

Police spotted Levar Jones on Front Street, across from the Emporium Building, having a nap behind the wheel of his parked car.
The engine of the vehicle was running, the court heard. Police turned off the ignition and arrested Jones for being in care and control of a car whilst impaired.
A test revealed some 111 milligrames of alcohol in 100 millilitres of blood was found in Jones' system. The legal limit is 80 milligrammes of alcohol in 100 millilitres of blood.
Jones, who pleaded guilty to the offence, was fined $600 by Acting Senior Magistrate Edward King and banned from driving all motor vehicles for 12 months.
"If you want to sleep get in the back seat, roll the windows down, and hide the keys,'' Mr. King told Jones.
"You cannot be deemed to be in control then.'' Jones then told Mr. King: "I was not doing any harm to anybody.
"In your case you were in the cockpit,'' said Mr. King.
