Police interview reveals Hypolite denied stabbing Nicholas Dill
Murder-accused Andre Hypolite told detectives he was attacked himself during the drug and sex session in which Nicholas Dill was killed — and that he did not stab Mr. Dill or his girlfriend.
The Supreme Court jury yesterday heard a tape recording of Hypolite, 37, claiming he got so frightened after "everyone went berserk" at the party that he ended up escaping by jumping out of a window.
He was interviewed by Police two days after Mr. Dill, 43, was killed in December 2004. Hypolite denies murdering Mr. Dill by stabbing him and seriously wounding the victim's girlfriend Stacey Pike, 37.
The tape, played by Crown Counsel Cindy Clarke, revealed Hypolite told Police he had gone to Mr. Dill's Warwick house after Ms Pike met him on the street and asked him for cocaine.
Hypolite, Mr. Dill, Ms Pike and a fourth person, Shakai Govia, all smoked drugs, according to Hypolite, before Ms Pike and Hypolite took part in a sex act while Mr. Dill watched a pornographic film.
"After a while, everyone of them started acting differently and I got hit on the head and, in fact, didn't really know what was happening," Hypolite told detectives.
"Everything, everyone just went berserk and I felt somebody tugging at me and I got cut.
"And I tried to pull myself free and get off, right, as two people would have, they were trying to grip at me, pull me to the ground.
"In the process, I have got some lacerations with my left leg and someone had something sharp in their hand and when I grabbed it I got cut on the left hand.
"I guess things got out of control, I got, I got jumped from behind by Nick and he bit my back and was holding a machete around my throat and Stacey was trying to grab something — grab a knife or something — and I was trying to, to hold, hold her hands. Down.
"There was just — blood was on the ground and I was slipping, trying to get away from everybody.
"Yeah, and then, then I got the cuts on my chest and Stacey was like swatting at me, and then Nick had fallen down, and I heard him hallo out.
"I don't know what had happened. And then she started throwing a chair at me and I fell down and something stopped me.
"So then, I, I ended up trying to throw a chair to keep, keep everybody away from me.
"I just jumped out of the window and got away."
The prosecution alleges Hypolite stabbed Mr. Dill in the back after Mr. Dill changed his mind about taking part in a sex act with him while both were in bed with Ms Pike.
Yesterday's tape revealed Hypolite told detectives that earlier on Boxing Day he had picked up a machete while at somebody else's home, but by the time he was at Mr. Dill's house he didn't think he had any knife other than a flicker knife.
He twice denied stabbing Mr. Dill, and when asked whether he had stabbed Ms Pike, he replied: "No, not that I recall."
The trial continues.
