Three people fined, banned from the roads for impaired driving
Three people appeared in Magistrates' Court yesterday on impaired driving charges.
Anne-Marie Porteous, 39, of St. George's, and Bothalage Fernando, 34, of Devonshire, admitted to being over the drink-drive limit.
Marvin Paynter, 60, of Tommy Fox Road in St. George's, admitted to failing to comply with Police to give a sample of breath for analysis.
The court heard Porteous was driving a black car on Tommy Fox Road, in St. George's, on Sunday. Police noticed she was passing over into the west bound lane and they pursued and stopped her vehicle.
While talking to Porteous, officers noticed she smelled of alcohol, her speech was slurred and eyes were glazed.
Asked if she had been drinking Porteous said: "Yes sir I have. It's my birthday. (I had) more than the average person."
She was arrested for driving while impaired and taken to Southside Police Station.
A breathalyser test revealed she had 168 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80 mg per 100 ml of blood. In court yesterday Porteous said: "I am regrettable about doing that. I will never do that again."
Fernando was caught swerving from side to side while riding his cycle on Middle Road, in Devonshire, last Thursday. Officers noticed he smelt strongly of intoxicants and his speech was slurred.
They arrested him and took him back to Hamilton Police Station, where a breathalyser test showed he had 139 mg of alcohol in his system.
Paynter was caught driving from left to right across the roadway on September 30.
The court heard Police on patrol on Angle Street stopped the driver, who smelt strongly of alcohol and had glazed eyes.
He made no reply when cautioned about the offence and refused to give a sample of breath for analysis.
All three drivers were given a mandatory $1,000 fine and 12 month driving ban by Senior Magistrate Archibald Warner.
