Victim suffered fatal knife stab to heart, expert tells court

Expert witness Chitra Rao, a forensic pathologist from Hamilton, Ontario, conducted an autopsy on Mr. Hill on August 12 2008. The 18-year-old had been stabbed to death five days earlier as he left a late-night party at Elbow Beach.

Dr. Rao explained that Mr. Hill suffered a single fatal stab wound to his chest, which penetrated his heart. The wound was around 4cm in length but she could not measure the depth because a surgical incision had been made on top of it during attempts to save Mr. Hill's life.

He also suffered two stab wounds to his left forearm which she described as non-fatal injuries. She went on to describe various abrasions on Mr. Hill's face, one of which was a U-shaped injury on the left of his forehead. She said it could have been caused by a blunt object with a rounded edge such as the round end of the handle of a cane.

Dr. Rao described numerous other abrasions on areas including the victim's shoulder, knees, chest, hand, and lower leg. She said he showed signs of defensive wounds suffered as he tried to ward off an attack.

Five teenagers stand charged with murdering Mr. Hill and possessing various weapons charges they all deny. Prosecutors allege that Kellan Lewis, 17, and Gary Hollis, 16, snatched a gold chain from around Mr. Hill's neck. A fight ensued, and Kevin Warner ,19, Devon Hairston, 18, and a girl, Zharrin Simmons, 17, are alleged to have joined the other two in striking Mr. Hill.

Next, Lewis is alleged to have removed a knife from his pants and stabbed the victim around his chest and body, before Simmons stuck Mr. Hill with a screwdriver. Prosecutors say he stayed on his feet and tried to get away but was struck with a walking cane by Warner who used so much force that it broke.

Quizzed yesterday by prosecutor Michael McColm over what could have caused the stab wounds, Dr. Rao said it was a sharp instrument such as a single-edged knife. She ruled out the suggestion that the wounds could have been inflicted with a screwdriver.

The pathologist believes the knife used to inflict the chest wound was around 4cm wide. She said the first wound to the forearm appeared to have been inflicted by a narrow, single edged implement. She explained that it could have been inflicted with the same knife as the chest wound if only the tip was used or could been an entirely different instrument.

Dr. Rao said the second stab to the forearm was likely caused by the same knife used to inflict the chest wound.

Warner's defence lawyer Elizabeth Christopher quizzed Dr. Rao over her assessment that the U-shaped injury on Mr. Hill's forehead was inflicted by something with a rough surface. The doctor replied that a broken cane could cause such an injury.

The trial also heard from the teenage girl who hosted the party at Elbow Beach that night. The teenager, who was 14 at the time, explained it was organised because she was going away to school. The Royal Gazette is not publishing her name due to her age.

The event was advertised via flyers and the MySpace social networking website and the girl estimated there were 100 people on the beach and 25 in the lane leading to it when the incident happened.

"I heard someone say 'fight, 'fight'," she told the court, explaining that she ran to the beach from the lane to fetch her Mom. She then heard a voice from the parking lot in the lane say someone had got stabbed. When she got closer, she saw someone she did not know lying on the ground.

"He just opened his eyes once and then closed them," she recalled.

The girl also told the court she knew a boy called Kellan who had been at the party with "Gary" and "Zharrin" who she also recognised. She did not see any of them when the person was lying on the ground.

The trial will not sit next week as Judge Charles-Etta Simmons is unavailable, but will resume on June 29.
