I saw Cavendish Road death crash – witness

A 32-year-old Pembroke man overtook a car before he collided and killed teenage sports star Machai Campbell, Supreme Court heard. Sergio Pacheco who is of Portuguese descent and will have a translator during the hearing, plead not guilty to killing the 19-year-old on December 30, 2008.

Mr. Cambell, who was a much respected member of Bermuda's under-19 cricket team and who also played football for Dandy Town, died after his bike collided with another on Cavendish Road.

Yesterday, Crown counsel Nicole Smith argued that this happened when Pacheco crossed onto the wrong side of Cavendish Road, around 12.30 pm on December 30th when driving into town. Mrs. Smith said: "At around the same time Machai Campbell was riding out of town on a motorcycle in the easterly direction on Cavendish Road.

"The two collided and the collision resulted in the death of Machai Campbell. At the time of the collision, the defendant, Pacheco, was on the wrong side of the road for the direction in which he was travelling."

Prosecution's first witness, Kieran Evans, a student from Devonshire, told Supreme court he was driving into town along middle road on December 30 when he was overtaken by a man on a black motorcycle.

Mr. Evans explained how the man, Pacheco, passed him twice before he finally overtook a car near Hibiscus Lane and Cavendish Road and collided with Mr. Campbell.

He said: "As I got in the area of Lane Hill the man on the black motorcycle overtook me and then over took the car that was in front of me and as he was on the wrong side of the road.

"I did not see Machai until I got to the top of the hill. I was riding and then I saw Machai. The man on the black motorcycle was on his side of the road.

"The guy on the motorcycle went left and Machai went right so they both went the same way. They collided into each other. The silver bike that Machai was riding spun off and came on my side of the road and as I was trying to avoid the bike I wasn't able to. The silver bike collided into my bike and I fell off my bike as a result."

Charles Jolliffe, the Prosecution's second witness, said he was driving the car that Pacheco overtook "like a rocket" before colliding with Machai.

Mr. Jolliffe explained he had pulled out of Hibiscus Lane onto Cavendish Road heading towards town when he was overtaken by the defendant moments before the collision. He said: "I went across the road towards Hamilton. As I continued to travel (into town) a bike shot across me like a rocket. He was speeding.

"The bike was on the right hand side. The lane coming out of Hamilton and the bike was travelling towards town. I saw the bike strike another bike."

Richard Horseman, the defendant's lawyer, argued that Mr. Jolliffe had not taken enough time to pull out of Hibiscus Lane, which has a blind left corner and had not seen the black bike travelling along Cavendish Road.

Mr. Jolliffe adamantly denied this and warned the defence lawyer not to call him a liar saying that he had not been driving recklessly and repeated that he had edged his way out of the road. The Supreme Court also heard evidence yesterday from Dr. Desiree Spriggs who confirmed there had been no drugs or alcohol found in Mr. Campbell's system.

The case continues Monday with one more witness for Prosecution.
