Kellan Lewis was convicted based only on the evidence of an unreliable witness, defence lawyer John Perry QC today told the Court of Appeal today.Lewis is appealing his convictions of both manslaughter and possessing a bladed weapon in connection with the killing of 18-year-old Kellon Hill.On August 9, 2008, Mr Hill was leaving a party at Elbow Beach when he was set upon by a group of teenagers and suffered a fatal stab wound.Lewis, who was 16-years-old at the time of the incident was sentenced to 12-years imprisonment for his part in the killing, but Mr Perry said that the only evidence that suggested his client killed Mr Hill was the testimony of a single witness.The sixteen-year-old witness told the Supreme Court during the trial that she saw Lewis stab Mr Hill, but Mr Perry dismissed her evidence, saying it was contradicted by forensic evidence, statements from other witnessess and her own testimony from an earlier trial.Instead, he told the Court of Appeal that the evidence “overwhelmingly” suggested that Zharrin Simmons, who was acquitted of charges of murder and possessing a weapon in connection with the incident the incident, was the one who fatally stabbed Mr Hill.“I’m not saying that the judge failed to identify the weaknesses in evidence, I’m just laying out the weaknesses,” Mr Perry said.
