Civil Aviation publishes exemptions for Bermuda-registered planes to be leased elsewhere

Recently advertised exceptions to the Air Navigation (Overseas Territories) Order 2007 will allow Bermudian registered planes to be leased to operators in another country.Two notices in the Official Gazette, posted by the Director of Civil Aviation Thomas Dunstan, noted that exemptions to the legislation were being offered to AWAS 5031 Leasing Limited and AWAS 5106 Leasing Limited.A spokesman for the Department of Civil Aviation yesterday explained the exemption, saying: “The exemptions are to do with the definition of the ‘Principal place of Business’ which has recently been deemed as not clearly defined in the current Overseas Territories (OT) Regulations.“The exemptions allow these aircraft to be registered in Bermuda through a Bermuda company, whose Directors are resident in Ireland, and lease the aircraft to an operator in a third country.“These exemptions will continue to be issued until the Air Navigation (Overseas Territories) Order 2007 has been amended.”
