Barber not guilty of causing crash

Not guilty: Eric Dunkley was acquitted yesterday

A barber was yesterday acquitted by a jury of charges that he caused a three-vehicle collision.Eric Dunkley, 44, was found not guilty of causing bodily harm to taxi driver Christopher Dailey by reckless driving by a majority of ten to two.The charges related to a crash which took place at around 4.30am on June 5, 2011. The collision occurred in the westbound lane of Southside Road, near the Pizza House Restaurant.The court had heard Mr Dunkley’s jeep collided with Mr Dailey’s taxi. Moments later a third car, which had been travelling behind Mr Dunkley, struck one or both of the vehicles.Both the defendant and the complainant were taken to King Edward VII Memorial Hospital for treatment. Mr Dailey suffered minor injuries including a bruised and sprained foot, multiple cuts and back pain, and was released from hospital later that morning.Mr Dunkley’s injuries were more severe, including multiple broken bones. He remained in hospital for almost two weeks.Prosecutors alleged that Mr Dunkley, who was travelling east, was travelling at excessive speed racing the third vehicle, and for an unknown reason lost control and veered into the westbound lane.An eye witness told the court she had seen Mr Dunkley’s jeep and the third vehicle speeding down the road prior to the crash, virtually bumper-to-bumper.However Mr Dunkley told the court Mr Dailey was in the wrong lane, and he had veered into the westbound lane in an effort to avoid a head-on collision.Mr Dailey, while on the stand, admitted having a single beer at Gombey’s Bar and Restaurant hours before the collision and falling asleep in his taxi, but the defence alleged he drank more than he admitted.
