CoH will challenge Govt’s takeover of its finances

The Corporation of Hamilton is challenging Government’s decision to oversee all financial dealings at the municipality.

Government stepped in to take temporary control of City Hall’s purse strings last month, shortly after a damning report citing numerous examples of maladministration at the Corporation was completed by Ombudsman Arlene Brock.

But Mayor Graeme Outerbridge’s Team Hamilton administration has now taken steps for a judicial review to be held into that decision and has filed a writ with the courts.

The Corporation has fought — and lost — a series of legal battles in recent months and even hired a top London law firm on a $200,000 retainer.

When Home Affairs Minister Michael Fahy announced the decision just before Christmas, Deputy Mayor Donal Smith warned that it would likely result in another legal contest for the Corporation.

“The Minister is the Minister and he is sure he is working within the law.

“We take a different position and our attorneys are advising us accordingly,” Mr Smith said.
