The issues
Editor's note: Below is the list of grievances sent to the Bermuda Cricket Board by Ellsworth Christopher and his supporters on June 25. The document contains numerous grammatical errors and spelling mistakes, but The Royal Gazette has taken the decision not to edit it, so as to avoid any accusations of doctoring the contents.
ISSUES
(1) B.C.B.C. change of the name to B.C.B. is unconstitutional considering the 1995 Bermuda Cricket Board of Control Act which would require a legislative amendment to the 1995 Bermuda Cricket Board of Control Act and Constitution.
(2) The election of a non-Bermudian to the Executive Office is unconstitutional (See B.C.B.C. Constitution)
(3) Change of Constitutional Term of Office of an Executive from yearly to a 5 years period was done in an A.G.M. and no advance notice whereby Clubs were able to discuss the matter before and required a Special Meeting to be called in accordance with the Constitution.
(4) Election of an Officer by e-mail as opposed to a General Meeting. No Provision in the Constitution for this procedure.
(5) Reducing the Representation of Charter Members and eliminating the Counties representation is deplorable disenfranchising established cricketing organization.
(6) Failing to appoint Honorary Presidents and Vice-Presidents and other Irregularities.
Secondlv, Lack of Transperancv (Undemocratic)
(1) Lack of Minutes of meetings distributed to Clubs if therefore causig a disconnect and alienation with Affiliates.
(2) The Financial Reports published over the past 2/3 years, (non-disclosure of Administration)
(3) In breach of the Constitution there were infrequent meetings called to discuss and apprise the Affiliates of the matters concerning Bermuda Cricket, no doubt contrary to the Constitution.
(4) There were very important policies made without consultation with the General Council or the Affiliates of the B.C.B.C..
(5) There were employment of staff of the B.C.B.C. without consultation with the Affiliates.
(6) There were Job descriptions which came into existence without consultation with the General Council or Affiliates.
(7) There is a position created, a Chief Executive, without a Constitutional provision and the Affiliates were not consulted.
(8) The office of the so-called Chief Executive was given certain powers and authority without consultation with the Affiliates.
(9) The continuous efforts to change the Constitution to limit or eliminate the representation or voting rights of the Affiliates.
(10) Wages and Job Description of auxiliary staff which was never approved by the Affiliates.
(11) The Selection of important Committees without the consultation wuth the Affiliates.
(12) Creating an atmosphere of intimidation by threatening individuals who question the Board’s policies and decisions.
(13) Efforts to select and control representation by creating a list of representatives and individuals contrary to the Constitution which allows Affiliates the freedom to send the Statutory numbers but necessary for the same persons to meet albeit that such meetings have been infrequent. Hence, efforts to disenfranchise Clubs.
(14) The intolerable efforts to dictate to the Affiliates (who own the Board) through an unconstitutional officer operating under the office of Chief Executive who was also a non-Bermudian.
Treatment of The National Squad
(1) The lack of good faith in negotiating a falr contract. Contract with the national players for the World Cup.
(2) Their treatment was demoralized and indignent
(3) The proposed Contract was disgraceful. Such Contract can be considered in breach of the Bermuda Constitution, Employment of 2001 Human Rights and Natural Justice and The Bermuda Cricket Board of Control Constitution.
(4) Failing to properly financially compensate the members of the Bermuda National Team.
Conclusion
(1) This Admiistration has created a Culture and atmosphere of dictatorship as the Bermuda Cricket Board of Control failed to communicate and consult the Affiliates on important matters and create unconstitutional positions.
(2) Finally, this administration has promoted a policy whereby non-Bermudians manage the B.C.B.C. and unelected persons are exercising the authority which is constitutionally in the jurisdiction of a properly elected President.
International issues I.C.C. Representation (Bermuda is currently being represented by an Englishman and there are vital issues such as Zimbabwe representation which is being threatened to include Ireland. This is a racial issue.
(3) In conclusion, the Executive of this National Body has failed the 13 Affiliates, especially with the failure to properly produce an adequate Financial Statement, and we now request a full audit by the Minister of Youth and Sports of Bermuda Cricket Board of Control funds over the past 5 years.
