Witness describes CCTV footage at club on night of fatal shooting

The Supreme Court was yesterday shown CCTV footage of both David Clarke and his alleged killers in the hours leading up to the fatal shooting.

Jahkeo LeShore, 32, and Darrion Simons, 20, both deny the premeditated murder of Mr Clarke, 26, on the evening of April 17, 2011. Mr Clarke was driving home from the Mid-Atlantic Boat Club when he was shot near the entrance to Bandroom Lane.

Prosecutors have suggested the killing was in retaliation for the murder of Mr LeShore’s brother, Jahmiko, who was gunned down six weeks earlier.

As the trial continued yesterday, the jury was show CCTV footage of the Mid-Atlantic Boat Club from the night of the shooting, where both the defendants and the victim had been prior to the killing.

Prosecution witness Craig Belton, who had reviewed the footage, said that Mr LeShore was first seen entering the club at around 7.12pm wearing a black jacket and white shirt. Over the next few minutes, he is seen talking to people at the bar before heading to an outdoor patio.

He told the court that a few minutes later, Mr LeShore left the club on a motorcycle with a man identified as Christopher Paris, returning just before 7.30pm. Mr Belton said Mr LeShore then appears to leave the club again, returning a short while later with Mr Simons, seen wearing an orange, hooded top and a black jacket.

The pair later walk outside, where they are seen interacting with Mr Paris, Jay Dill and Dameko Dublin among others.

Shortly after 8pm, a man Mr Belton initially identified as Mr Clarke is seen to enter the bar, walking past Mr Paris and Mr Dublin. However Mr Belton said by that stage in the evening the recording had become “wishy-washy black and white”, and in cross examination accepted that while Mr Clarke was present in the club, he had not been the man seen in that portion of the recording.

In cross examination by defence lawyer Larry Mussenden, Mr Belton said that based on the recording shown in court the man seen entering the bar was likely not actually Mr Clarke.

A few minutes after 9pm, Mr Belton said Mr LeShore is seen leaving the bar, followed shortly afterward by Mr Simons. Mr Simons later re-enters the bar, approaches Mr Dublin, and leaves again. The witness said it was the last time he saw either of the defendants in the footage.

Meanwhile, Mr Clarke remained outside in the patio area of the club. At around 10.04pm, Mr Clarke appears to answer a call on his cellular phone — something Mr Belton said was confirmed by Mr Clarke’s phone records.

He later leaves the patio area and enters the club, passing Mr Dill and Mr Paris. Mr Clarke is seen walking through the club and into the parking area. Moments later, a motorcycle is seen leaving the property and travelling west along North Shore Road.

“This is the only vehicle leaving at this time, and almost certainly is the victim,” Mr Belton stated.

As the vehicle turned, Mr Belton said Mr Dublin can be seen opening his cell phone. He then walks through the club to the patio. Minutes later, at around 10.18pm, Mr Belton looks at his phone and begins to gesture wildly before shaking one man’s hand and hugging another.

Over the next few minutes, several people in the crowd are seen to look at their phone and the group went back into the bar where several of the men appear to dance, waving their arms in the air.

“They appear to be in a celebratory mood,” Mr Belton added.

However, during cross examination by defence lawyer Larry Mussenden, Mr Belton acknowledged that the men were seen dancing at several times during the evening. He also accepted the suggestion that based on the recording the mood in the bar had been “social and friendly”, with Mr Clarke chatting and bumping fists with many people, including Mr Dublin.

The trial continues.
