Man banned and fined for refusing breath test

A man who refused to take a breath test was banned and fined in Magistrates’ Court.

George Silva, 59, admitted refusing the test, but not guilty to a driving while impaired charge.

Last week the court heard on that a motorist was driving on North Shore Road but was forced to break heavily to avoid a collision after a motorcyclist cut them off at My Lord’s Bay Lane in Hamilton Parish.

Police were alerted to the erratic driving and stopped Silva on Palmetto Road in Devonshire.

He told police when questioned: “I had about three or four beers” and disputed the need for a breath test.

Officers took Silva, of Warwick, to Hamilton Police Station for a breath test but Silva refused. He said to police: “I told you, I’m not drunk.”

Silva was taken to the Bermuda Police Station and further refused to take a breath test.

He was later arrested on suspicion of impaired driving and for refusal to take a breath test.

The incident happened on October 5.

Magistrate Tyrone Chin banned Silva from the roads for a year and fined him $800.
