Court warns men after fight outside nightclub

A corporal in the Bermuda Regiment pleaded guilty in Magistrates' Court to fighting outside Level nightclub.

David Lambert, 21, of Aubrey Road, Hamilton, appeared in court along with Travon Talbot, 19, of Brighton Hill Road, Devonshire, charged in an affray that happened around 3 a.m. on Front Street in February.

And a third man Sewaid Smith, 21, of Radnor Road, Hamilton, who had appeared on charges related to the incident was given a mention date later this month.

Magistrate Khamisi Tokunbo sentenced both Lambert and Talbot to 18 months conditional discharge for their part in the fight.

On the night in question — Saturday, February 16, — Lambert was fighting with another man outside the Level Nightclub.

When Police arrived to break up the fight, Talbot also arrived to help Lambert and became involved in the affray.

Using pepper spray, officers tried to quell the disturbance, which led to both men being arrested and arriving in Magistrates' Court yesterday.

Defence lawyer Larry Scott, who was representing Talbot, said this was a clear indication of the "red bloodedness at its best".

He added: "I think everybody has learned that when the Police are on the scene they need to back-off."

Lambert apologised for his actions and Talbot apologised to the officers and said he hoped he could put this behind him and continue his education.

Mr. Tokunbo said he would take the evidence by the prosecution into account as well as both men's previously clean records.

He added: "No evidence was offered on the resisting arrest and in the view of your previous clean records I am going to give you the opportunity to keep that on track. For both of you it's conditional discharge of 18 months."
