Student describes intervening in alleged city street fight

A brutal attack on Damon Robinson ended because a 17-year-old student jumped into the fray, a Supreme Court jury heard yesterday.

Olivia Joell was on her way home when she saw two men attacking the 32-year-old outside Champions Sports Club on Reid Street.

"I jumped off my bike and dropped everything and was just running towards them," she said. "They backed off and was running towards Champions. I called 911 and as I was on the phone, the guy who's accused ran towards him and kicked him in the head."

The witness said she stayed with the victim until the ambulance came because she didn't want anything else to happen to him.

Frederick Anthony Swann, 27, is accused of causing grievous bodily harm to Mr. Robinson.

The alleged fight took place around 5 a.m. on August 15, 2009.

The court heard the assault was led by 27-year-old Jermaine Simmons, who has left the Island. His girlfriend, 29-year-old Carlena Caines, is charged with being an accessory to the fact after a felony, and helping flee the scene and the Island.

Caines and Swann deny the charges.

The prosecution alleges Mr. Robinson was kicked repeatedly by Simmons and Swann as he walked down the stairs of Champions <\!m> and beaten unconscious outside the club.

Doctors at King Edward VII<\p>Memorial Hospital determined his jaw was broken in two places, he had a collapsed left lung, and bleeding and swelling to his brain.

Called as a witness yesterday, the alleged victim told the jury he could not recall much from that night.

"The last thing I<\p>remember is getting on a bike and coming to town," he said. "The next thing I remember is waking up in the hospital."

Mr. Robinson said he has headaches and jaw pain as a result of the beating.

Gladwin "Stella" Gilbert told the court he was on Front Street that morning and watched a man rummage through trash cans and pull out a bottle.

He said the man then ran around to Reid Street. By the time Mr. Gilbert got there, the man was unconscious.

The witness said he saw a man kick the man with the bottle and then go up into Champions.

During cross-examination, Swann's lawyer Larry Mussenden suggested that Mr. Gilbert's memory wasn't clear that night <\!m> or yesterday.

Mr. Gilbert agreed but maintained the man he saw doing the kicking was in the courtroom.

Edward Cook told the court he saw Mr. Robinson and Caines in Champions that night.

He said he has known Mr. Robinson since primary school and Caines since high school.

The witness said he saw Mr. Robinson running around on Front Street like he was "out of his head".

He said he followed him to Reid Street where he witnessed a "scuffle" involving Mr. Robinson and two males.

Mr. Cook said he tried to break up the fight but then went into the club. He said he came back down later, and stayed with the victim.

"I said he was drunk and he was being an ass. He deserved a bust ass but I don't know if he deserved a bust ass like that."

He claimed the two attackers left the scene in a white car driven by Caines.

Mr. Cook agreed with Mr. Mussenden's suggestion that he was drunk that night.

The lawyer suggested that a darker skinned male was more involved in the fight, but Mr. Cook said he wasn't sure.
