Bingham, 27, of Cobbs Hill Road, Warwick, appeared in Magistrates' Court where he pleaded guilty to driving with excess alcohol in his blood.

Prosecutor Sgt. Phil Taylor told Senior Magistrate Will Francis that at about 2.10 a.m. on November 9 this year, Police officers on patrol on Front Street followed an auxiliary cycle which had no headlight on.

"They went into Crow Lane and the officers noticed that the cycle was swerving from left to right,'' said Sgt. Taylor.

He said the bike took a sharp turn nearly colliding with a wall and Police then signalled Bingham to stop.

Bingham took a breath test and the result showed he had 93 milligrammes of alcohol in 100 millilitres of blood. The legal limit is 80 milligrammes.

Kim White, who represented Bingham, said his client did not realise his bike's headlight was not on and that he told officers when he was stopped that he had had a few drinks.

Mr. Francis said: "He did have a low level of alcohol but the facts show he was affected.'' He fined Bingham $350 and banned him from driving all vehicles for 12 months.
