No luck for liquidators

Privy Council to overturn an earlier court decision to strike out a $20 million civil action they brought against former Focus directors Mr. David Thirkill and Mr. Douglas Pullen.

Although Bermuda Supreme Court yesterday refused to sanction an appeal, the liquidators can now apply direct to the Privy Council itself to be given permission to appeal to the Privy Council, which is the highest appeal court in the judicial system.

Mr. Saul Froomkin QC represented Focus' liquidators in the hearing, while Mr.

Coles Diel QC represented Mr. Thirkill and Mr. John Cooper acted on behalf of Mr. Pullen.

Immediately after the case, which is a small part of a multi-faceted legal tangle, Supreme Court began hearing another matter involving former Focus boss Mr. Mark Hardy.

Mr. Hardy is appealing against a previous default judgment amounting to $20 million which was previously made against him after he failed to comply with an order for certain financial disclosures.
