Three-times over the limit drink-driver fell from scooter

A man three times over the limit was caught drink-driving after he fell off his scooter on the way home.

Ivan Breen, 30, of Hope Lane, Warwick, fell off his motorcycle twice after driving home from Front Street on March 1. He pleaded guilty to impaired driving at Plea Court yesterday.

Paula Tyndale, Senior Crown counsel, said Police officers followed Breen after they noticed him "swerving from side to side along Front Street".

As he approached Trimingham Hill, he then "narrowly escaped a collision with a sidewalk".

He continued on his way to Paget but then tumbled near the junction with South Road.

"He lost control of the cycle and fell into the road," said Ms Tyndale.

The court heard Breen got back on his motorcycle, only to fall off for a second time. He was helped up by a Police officer, but then stumbled.

"One of the officers held onto him and noticed there was a strong smell of alcohol on his breath," said Ms Tyndale.

Breen was asked whether he had been drinking, to which he replied "yes".

He consented to a breath sample and was then taken to Hamilton Police Station where a blood sample showed 241 milligrams of alcohol in 100 millilitres of blood, the legal limit being 80 milligrams.

Breen told the court yesterday: "I'd just like to apologise for any inconvenience caused."

Magistrate Khamisi Tokunbo banned him from driving for a year and fined him $800.
