being fined in Magistrates' Court on Monday for refusing to take a breathalyser test.

King was stopped by Police on Front Street at 3.15 a.m. on Saturday, July 25 while driving a livery cycle without a helmet. She was arrested and agreed to take a breathalyser test.

But when she got to the station, the 33-year-old tourist was unable to give a sufficient sample of breath.

Lawyer Mr. Mark Diel said the first time King tried to take the test she was told she did not puff hard enough. The second time, she was told she didn't exhale long enough. He said King was refused a third chance and was then detained at a mixed-sex facility from 4 a.m. until 10 a.m.

Mr. Diel complained about the Police treatment of King saying it was not the sort of thing a visitor should be subjected to. He suggested the Police could have driven her home.

Police Insp. Peter Duffy, prosecuting, said Police did not operate a taxi service.

He also said visitors were sometimes kept by Police overnight because they are unable to provide sureties to allow for bail. Although King was staying with friends, Insp. Duffy said, it was 4 a.m. at the time of her arrest. He said King did not strictly stay in custody overnight -- only six hours, from 4 a.m.
