yesterday after he pleaded guilty to refusing to take a breathalyser test.

Douglas McEwen, 45, of Cedar Park, admitted committing the offence on Middle Road, Pembroke on November 2.

However he denied driving a vehicle or being in control of one while impaired and prosecutor Sgt. Phil Taylor offered no evidence on the count.

Police found McEwen sitting by his bike on the junction of Lane Hill and Middle Road after he had reportedly fallen off.

McEwen appeared to be drunk and admitted he had "had a few'', Sgt. Taylor said.

He refused to take a breathalyser test and was arrested on suspicion of drunk driving.

McEwen told the court that he refused to take the test because he was not riding the bike.

He said he had been riding the bike when "the fresh air hit me so I parked the bike and was waiting for a taxi to come''.
