Appeal court starts

Residents living near Giant Foods in Warwick and the Island's fishermen have different interests in cases scheduled over the next month.

Court of Appeal today.

Residents living near Giant Foods in Warwick and the Island's fishermen have different interests in cases scheduled over the next month.

Next Monday, Giant Foods will appeal against the Liquor Licensing Authority which denied them an application to serve liquor at its Middle Road store.

The Chief Justice, the Hon. Sir James Astwood, threw out an earlier appeal this year.

This signalled victory for Warwick Academy and local residents who feared that children may come into contact with liquor if it is sold in the store.

Giant Foods is one of the few groceries in Bermuda which does not sell liquor.

Its previous owner refused on religious grounds. New owner Mr. George Whitecross argues that his business needs to sell liquor to be profitable.

Fishermen will be watching the Court of Appeal, on Friday, November 20, when Dennis Farias will appeal against a conviction and fine of $2,000 for illegal use and possession of fish pots.

If Farias wins his appeal it could affect Bermuda's ban on fish pots which has stood since 1990.

The ban was imposed in April of that year to halt a dramatic decline in the numbers of reef fish.

Farias believes it is unconstitutional and a breach of natural justice. He refused to follow other fishermen who handed in their fish pots and received compensations.

He did not fill in the necessary forms of surrender for his fish pots and received nothing, but he was caught with the pots and fish and charged with violating the ban.
