XL settles coverage dispute with chemical maker
Business Insurance mamagzine reported the dispute focused on payment of $500 million Du Pont made for claims for damage by one of it fungicidal products.
Both XL and Du Pont confirmed they struck a deal on October 8. XL senior vice president Mr. Gavin Arton said: "As part of the terms of the agreement, XL cannot disclose and discuss the terms of the agreement''. After mediation said to involve at least a dozen people, X.L. and Du Pont agreed to settle their dispute over coverage for liability payments in two separate settlements, relating to the fungicide, Benlate.
One of the parties is said to have been Terra International Inc., a US agrochemical concern that manufactured the fungicide under contract with Du Pont.
XL brought all the parties together and pointed out that it would take a similar approach to large disputed claims in the future.
Du Pont paid $500 million in claims after recalling the fungicide in 1991 When Benlate was recalled, du Pont had $300 million in excess liability coverage excess of a $50 million self-insured retention. XL wrote the first $100 million in coverage and ACE Insurance Co. Ltd the next $200 million.
