Laws to crack down on counterfeit goods now in effect

New legislation to crack down on the importation and sale of counterfeit goods has taken effect.

The Trade Marks (Customs) Regulations 2025 allow Bermuda Customs to stop counterfeit goods at the border, with those caught importing or selling such goods facing fines or even jail time.

Jason Hayward, the Minister of Economy and Labour, said: “Counterfeit goods are not just a global problem; they affect our local businesses, consumers and economy.

“The new Trade Marks Act 2023 and related regulations give Bermuda the tools to protect intellectual property and stop counterfeit goods from entering our market.”

The new laws, which took effect on August 1, make importing for sale or selling counterfeit goods illegal in Bermuda.

Counterfeit goods are fake items made to look like authentic brands without the owner's permission.

A 2025 study found that counterfeit goods accounted for almost $467 billion in international trade in 2021, with clothing, shoes and leather items the most affected.

Mr Hayward said: “Buying fake goods for personal use is not illegal, but bringing them into Bermuda to sell or make money from them is against the law.

“Even if someone unknowingly imports fake goods to sell, those items can be seized and the seller prosecuted.

“I urge businesses and the public to be careful and avoid counterfeit goods. By following the law, we protect our economy, our consumers and our local businesses. Bermuda will take strong action to stop the sale of fake goods.”
