Trott was crying for help, witness says

A man accused of murdering a mother of three allegedly told Police that he would ?kill her again? if he had the opportunity.

The trial of George (Messy) Macdonald Liburd began in Supreme Court yesterday after almost three years of delay.

Liburd, 32, has pleaded not guilty to murdering Chena Danette Trott in August, 2002 at the Esso Tigermart station in Hamilton Parish.

As prosecution lawyers opened the case, the five man, seven woman jury heard witness testimony from several friends of Ms Trott who claimed Liburd stabbed his victim repeatedly before leaving her to die on the pavement outside the service station.

Liburd, who is represented by Queen?s Counsel John Perry and co-counsel Anthony Richardson has pleaded guilty to manslaughter with diminished responsibility. That means he has accepted that he killed Ms Trott, but not by premeditated murder. Lawyers for the defence will have to prove Liburd was suffering from an abnormality of the mind which impaired his mental responsibility at the time of the killing.

Prosecution lawyers did not accept the plea, and argued before Puisne Judge Charles Etta Simmons that Liburd did intend to kill Ms Trott.

The court was also shown photographs of blood spatters around the area where Ms Trott was allegedly killed and a blood stained towel and sheet also found outside the service station.

Senior Crown counsel Carrington Mahoney told the court: ?Ms Trott?s death was caused by voluntary deliberate conduct of the accused and was not by accident.?

According to statements taken by Police after the incident, Liburd allegedly said, ?I used a knife to kill her, that girl is a f***ing bitch, I?d do it again. When I loved we loved deep, that girl played a f***ing game on me, I?d f***ing do it again?.

The court heard that Ms Trott arrived at the gas station in a car with a friend, Debbie Muwwakil who was picking up her daughter, an employee at the gas station.

Prosecution witness Beverley Ann Pitt, a friend of Ms Trott?s, said she saw the victim inside the car and gestured for her to come into the Tigermart to have a chat. They finished their conversation and her friend turned to go, however, she noticed Liburd standing in the shop behind Ms Trott. She went outside to investigate after being alerted to a quarrel.

She said went around the side of the service station and saw Ms Trott standing close to the dumpster with Liburd who was gripping her and pulling her around the back of the building.

?He gripped Chena, he took her around the back, she was telling him to leave her alone,? she said. ?When she was around the side of the building I could see her body jerking up, she was facing me, she was crying for help.?

Ms Pitt, who was crying as she gave her testimony, said Liburd had a knife in his hands and stabbed his victim several times in her chest.

?He stabbed her three or four times, she was crying for help, she said ?help me Beverley, help me?. I tried to go over and help her but as I got closer he kept doing it over and over again. Every time I got closer he said ?I?m going to take your friend and the children?s mama from you?.?

Ms Pitt said her friend dropped down on the pavement in front of her, while Liburd ran off. Debbie Muwwakil and her daughter Tahyyah said they saw Liburd gripping Ms Trott, as she made violent back and forth body movements.

Mrs. Muwwakil said she saw Ms Trott by a car parked to the side of the station with Liburd.

?She was holding her body up, he had a knife in his right hand and white material in his left hand,? she said.

Her daughter, Ms Muwwakil, said she also witnessed Ms Trott call for help as she attempted to get away from her attacker.

?Chena was trying to get away, we were trying to help her, he was swinging a knife at everyone saying, ?she?s my wife, get away or I?ll kill her?.?

Ms Muwwakil said she saw Liburd attempt to push Ms Trott into the passenger side of the car as he shouted to bystanders, ?She?s my wife, get away, I?m going to take her with me. I?m going to kill her?.

The two went into the gas station and called the Police for help. The court heard that Liburd and Ms Trott had had a relationship and that Liburd had been served with a protection order on August 7, 2002, just two days before she died.

The court was also told that Ms Trott received two phone calls on her mobile phone on the way to the gas station, and she answered one of the calls.

Det. Con. Jewel Hayward presented a series of photographs to the court of items found on the eastern side of the Tigermart which included a bath towel and a bed sheet and a pair of flip flops stained with a substance believed to be blood.

A knife was also collected from a Paget residence at 4 p.m. on August 9, 2002. Later that evening, Det. Con. Hayward said officers collected a sock from the top rafter of a bus shelter opposite the Warwick Shell Station.

Members of Ms Trott?s family and relatives of Liburd sat on opposite sides of the courtroom. Liburd was under heavy guard surrounded by Prison Officers. The case continues today.
