Male manager sexually assaulted clerk - court told

A former office clerk who claims he was repeatedly sexually assaulted by his manager told a court yesterday he had “wanted to kill” the much older man.Mr X describing two of the ten assaults he claims took place between February and June 2009, when he was still a teenager said he felt “violated” but powerless to react for fear of losing his job and home. The 21-year-old took the stand as the key prosecution witness on the first day of the manager’s trial at Magistrates’ Court.The 58-year-old defendant Mr Y denies ten counts of sexual assault. Neither he, nor Mr X, who was 19 when the alleged attacks began, can be identified for legal reasons.Mr X began working in the office in February 2009, after serving time in Westgate. He said he was on probation and staying with a relative at the time, as he was homeless.The teenager was offered temporary work at the office and was introduced to the older man, who was general manager, by a female supervisor. Mr X said the defendant took an interest in him and asked him to “check back with him” to report on how he was doing.“When I first went there, when I first met him, I really kind of felt that he was really just trying to help me out,” said Mr X. “I was 19 years of age. Two years before that my father had died in my arms.”After finding accommodation with the assistance of his employers, Mr X said the defendant offered to help him move his belongings there on February 15, 2009. Once at the apartment, he claimed, Mr Y began questioning him about his plans for the day. “That’s when he proceeded to come closer to me,” said Mr X. “He proceeded to come closer to me and that’s when he extended his right arm out towards my genital area.”Explaining he still had on his clothing, Mr X said the defendant “began to feel on my genital area and whilst doing so looked me in the eyes, smiling, with his left leg shaking”.He said the assault lasted about a minute-and-a-half. Crown counsel Nicole Smith asked: “Did you say anything to him?”Mr X replied: “No. I pulled away from him. He proceeded to the door.”He said that after the defendant left: “I felt violated. I felt like reacting.”Ms Smith asked: “Did you react?”Mr X said: “Not in the way that I wanted to because I was still under probation. Also, I might have been kicked out of where I was staying. I might have lost my job.”He alleged that the second assault took place on February 19, in the manager’s office, when Mr Y gripped his belt and “pulled me closer towards him”.Mr X said the manager unzipped his pants before touching his genitals through his boxer shorts. “He again looked me face to face, with his left leg twitching,” he said. “I asked him what was he doing. He didn’t answer.“In the circumstances of me being on probation, I really didn’t know how to go about dealing with it. I didn’t want to deal with it. When it was happening, I kind of wished somebody had walked in and seen it so I could have some kind of proof, so it wouldn’t just be me saying he’s sexually touching me.”He added: “Once again, I felt violated. I felt truthfully, deep down in my mind, I wanted to kill him.”The female supervisor also appeared as a prosecution witness. She told the court she knew Mr X from his time as a student and said he was “upbeat” when he came to work at the office. The woman said he became quiet, grouchy and seemed depressed and she eventually advised him to leave.Under cross-examination by defence lawyer Shade Subair, the supervisor agreed she later found out his employment had been terminated. She said she had noticed nothing unusual about the two men’s interactions.The case continues.
