Drug dealer fined and jailed for three years
A drug dealer was jailed for three years and fined $63,000 by a magistrate minutes after receiving a two-year sentence from a judge in another case.Kenneth Thompson Jr, 24, admitted possessing cannabis and ecstasy after being caught red-handed by police on September 11, 2010. He also pleaded guilty to violently resisting arrest. Prosecutor Cindy Clarke told Senior Magistrate Archibald Warner officers spotted Thompson acting suspiciously outside Sandys Variety Store, shortly before midnight on the date in question. When informed he would be searched, Thompson, of Sandys, struggled with officers and tried to run away. Police saw him reach into his pocket and throw away a bag, which was found to contain 3.62 grams of cannabis. The court heard that he kicked and struck out while being subdued, hitting two officers. Thompson denied the two counts of assaulting police, and Ms Clarke subsequently dropped both charges.A search of his person uncovered 3.03 grams of cannabis resin in 22 separately wrapped twists which he said were not his and $537 in cash.He was within 300 metres of Somerset Primary School, which meant the offence was committed in an increased penalty zone.Ms Clarke said seven tablets of ecstasy were found early the next day when police searched Thompson's home. The street value of the drugs was estimated at $1,100 for the cannabis resin and $350 for the ecstasy.Thompson's defence lawyer, Victoria Pearman, asked for leniency, pointing out that Thompson has no prior convictions, had pleaded guilty, and has a ten-month-old son. Mr Warner replied that the maximum sentence he could give for the drugs charges was ten years' imprisonment. He jailed Thompson for three years and fined him $30,000 for possession of cannabis resin with intent to supply, and $30,000 for possession of ecstasy with intent to supply. He also meted out $1,000 for violently resisting arrest and $2,000 for possession of cannabis in an increased penalty zone.Mr Warner said if Thompson is unable to pay the fines, he will have two years added to his three year sentence. Mr. Warner did not state why he imposed such large fines. The offences were committed while Thompson was on bail over another case.Puisne Judge Carlisle Greaves dealt with that case in Supreme Court moments before the Magistrates' Court case.Thompson pleaded guilty to possessing cannabis with intent to supply and possessing drug equipment on November 17, 2008. Ms Clarke explained that police searched two bedrooms at his residence in School Crescent Lane, Sandys, on that date and found a digital scale, two pairs of scissors and a metal tray used for preparing drugs. In a third bedroom, belonging to a young child, officers found a bag containing 262.97 grams of cannabis, with a street value of $13,150. Thompson said: “I'm sorry. I would like to apologise to the court.”He originally faced the November 17, 2008 cannabis possession charge alongside his father, Kenneth Thompson Sr, and uncle Troy Govia.Thompson Sr and Jr faced a further charge of possessing 544 grams of cannabis with intent to supply on that date.Ms Clark accepted Thompson Jr's not guilty plea to that charge, and asked that his father and uncle be discharged from the case. The Supreme Court and Magistrates' Court sentences will run concurrently.
