A Devonshire man convicted of using a hand-held device while driving chose jail time over a fine today.Duane Lindo, 50, was pulled over by police on Middle Road in Southampton while riding his motorcycle on May 18, Magistrates’ Court heard.Lindo admitted he had an iPod on him and had earbuds in his ears at the time.He said today: “I was riding my pedal bike earlier that day with my earbuds in, and forgot to take them out when I got home and got on my motorcycle.”Senior Magistrate Archibald Warner ordered Lindo to pay $400 or spend 40 days in jail.He chose prison.
