Murderers’ sentences to be reconsidered

Convicted murderers Kevin Warner and Antonio Myers will have their sentences reconsidered as a result of a London Privy Council ruling.

Myers, 28, was given a minimum sentence of 38 years for the fatal shooting of 30-year-old Kumi Harford, who was gunned down in 2009.

Warner, 23, was sentenced to a minimum of 35 years in prison for the 2010 murder of Dekimo (Purple) Martin. The 24-year-old was shot three times in his own backyard.

However last month the Privy Council ruled in the cases of Ze Selassie and Jermaine Pearman that the minimum sentence for premeditated murder in Bermuda could not exceed 25 years.

In convictions of “simple” murder, such as Myers, the Council ruled that the minimum sentence should not exceed 15 years.

During hearings before the Court of Appeal this morning, panel president Edmund Zacca ruled that both men’s life sentences should remain in place however the minimum sentence should be reviewed by the Supreme Court.

The panel made a similar ruling yesterday in the matter of David Cox, who was sentenced to a minimum of 38 years for the premeditated murder of Troy (Yankee) Rawlins.

Director of Public Prosecutions Rory Field told the court that recommendations have been made to Attorney General Mark Pettingill for possible legislation which would clarify any new position on sentencing such cases.
