Rule changes may not help members
timeshare club that a Government review of regulations might not help them in their argument with club bosses.
The Minister made his remarks following complaints from members of the St.
George's Club last week over escalating maintenance costs at the resort. Some members have called for timeshare regulations to be reviewed.
Mr. Dodwell confirmed that a review of the Timesharing Act is currently being conducted -- but that any changes would not affect contracts between timesharers and the facility's management.
"It is very important to note that changes in the timesharing legislation may not necessarily have an impact on any contractual arrangements made directly between the developing/owner and managing agent of a timeshare operation and the timeshare club members.
"The Act sets out the relationship between the developing/owner and management agent and the regulatory authority, which in this case is the Ministry of Tourism together with the Ministry of Finance,'' he said. "On the other hand there is a separate and distinct relationship between the developing/owner and managing agent and the timesharing club members, and this is the primary area of concern.'' Mr. Dodwell urged all timeshare members to read through the Declaration of Club Membership Rights and Regulations -- the document which sets out members' rights.
"It is critical that if members have concerns about the rules they should continue to address their concerns to the St. George's Club management through the medium of the Members Advisory Council for resolution,'' Mr. Dodwell said.
