Arbitrators in Berkeley site visit today

Arbitrators are set for a site visit of the new Berkeley today as they begin preliminary hearings ahead of the battle over who was to blame for the massive delays and cost over-runs in building the school. Three overseas lawyers, led by English QC John Uff, will tour the school and begin to sort out preliminary issues but the arbitration itself may not start until the autumn, said Pro-Active lawyer Julian Hall. Pro-Active was awarded the $68 million secondary school contract in 2001 with a completion date of September, 2003.

The firm was given a year's extension and another $13 million in February, 2004 but they were sacked in August that year. Government blamed the company for delays while Pro-Active say constant design changes played havoc with the plans. The construction company is suing for wrongful termination from the school building contract while Government is counter-suing.
