Retroactive planning applications rejected

The Development Applications Board is getting tough on developers ? this week it refused seven of the 11 planning applications that came before it.

Two of the failed applications sought retroactive (after-the-fact) planning approval and when they were refused the DAB recommended Environment Minister Neletha Butterfield take ?appropriate action?.

Chris West, of 14 Cut Road, St. George?s was slammed for building a new dock, dock storage building, stairs and pathway on land zoned as woodland reserve.

?All forms of development shall be prohibited in areas of woodland reserve,? the DAB said. ?The Board wishes to express concern that the applicant has shown disregard for the planning process in that development was commenced prior to planning approval.

?The Board wishes to advise the Minister to take appropriate action,? it said.

Perry Puckerin, of 2 Footbridge Lane, Pembroke will also feel an enforcement action by the Minister about his unauthorised garden shed.

The shed exceeded the maximum site coverage allowed, it said.

And the wooden shed with a wooden roof does not comply with the ?Bermuda Image?.

Five other applications were refused.

BF&M Properties Limited was not allowed to build a proposed 29-berth marina (for the use of staff of BF&M and Companies owned by BF&M) because because the size and design of the proposed marina negatively impacted access into and out of Barr?s Bay.

Blocking access into the bay was a ?significant safety issue?, it said.

Troy Govia?s plan to build four dwelling units and a warehouse with office space did not include enough information, it said.

And the DAB said ?the Wellbottom (Southampton) Industrial area is not an environment that can provide for high standards of residential amenity?.

A proposed demolition of an existing home to make room for four new dwelling units by Field Real Estate care of the Bank of Butterfield was refused as not enough information was submitted as well as resulting in overcrowding on Mangrove Bay Road in Sandys.

Miss Denise Butterfield was not allowed to build a third dwelling unit at 46, St. John?s Road, Pembroke because it was on industrial land.

Four planning applications were approved.

Mrs. Katharina Harlow may build a third and fourth home, new access and two new pools at 17, Harrington Sound Road, Hamilton Parish.

However, the DAB did warn that if a new cave was discovered during construction, ?all work shall cease and an engineering report be provided to show the cave system is to be protected?.

Andrea Flood may build eight new homes and a pool at 11, Knapton Hill, Smith?s.

Shoshana Scott may build a second residence at Sound View Road, Sandys and Mark Pacheco of Smith?s received permission to build a new pool house.
