Santucci sues Police chief for ?pain and suffering?

Albert Santucci, the 45-year-old Southampton man who was pulled from a plane by gun-toting Canadian police in September last year and denied entry to the country, has filed a writ against Police Commissioner Jonathan Smith.

Mr. Santucci, who had graduated from Drug Court in August, 2004, claimed to be a victim of a Bermuda Police vendetta after undergoing a lengthy interrogation in Canada, given a cavity search and asked to give a stool sample ? despite producing a certificate showing his past convictions were spent.

He said he had been shown a copy of his past convictions which had been faxed to Canada while he was in mid-flight.

But according to the rules of Drug Court, his spent convictions can only be revealed with his permission, which had not been given.

He said last night he still did not know who had sent his record to Canada and Police had never told him.

?Whoever sent those records to Canada, broke my constitutional rights,? he said.

Mr. Santucci said last night that he had tried for four months to get an apology from the Police, but none was forthcoming which is why he had now decided to file a writ.

?I just don?t understand why someone would stoop so low,? he said. He said Canadian authorities told him to ?sort it out? in Bermuda before trying to return to Canada, which is something, he says he does plan to do.

Mr. Santucci will be representing himself and said he plans to sue for the ?pain and suffering? he had endured due to the incident in Canada.
