Breaking News: Final two accused in mob attack cleared

The two final men accused in a mob attack were cleared by a jury this afternoon — but promptly arrested in connection with the murder that occurred at the victim’s home last night.

Meanwhile news of that shooting was broken to the 12 women of the jury, who had been subject to a news blackout during their deliberations.

Many of them broke down in tears as Puisne Judge Carlisle Greaves told them a man was gunned down at the same Midland Heights Crescent premises that is the subject of the mob attack case.

“Arrangements are going to be made to seek to enhance your security and so on for some period of time,” he told the women, who looked horrified at the news.

As previously reported, a marathon session at Supreme Court saw three men convicted yesterday of the mob attack, one cleared, and a hung jury in the case of the remaining two defendants.

The three convicted — Kyle Tannock Williams, Bennett Phipps and Kiwaun Gilbert — were remanded into custody last night. The man cleared, Kaiwan Trott, walked free from court.

Meanwhile, in a rare move in Bermuda, the jury in the case was sent to a hotel overnight so they could continue to deliberate today on the fate of the two men they could not decide upon, Detroy Smith, 24, and Allan Douglas, 22. Mr. Smith and Mr. Douglas were released on bail overnight.

The jury resumed deliberations at 10.53 a.m this morning, and came back with majority verdicts of “not guilty” in respect of Mr. Smith and Mr. Douglas at 3.06 p.m.

As the pair left court, however, they were arrested by members of the Serious Crime Unit in connection with the shooting murder of a 40-year-old man at the same Midland Heights Crescent premises that was the scene of the mob attack. The shooting occurred around 10.30 p.m. last night.

The 23-year-old victim of the mob attack, Temasgan Furbert, described during the trial how he was set upon near his home in Midland Heights Crescent by a group of 20 to 25 men on the night of February 27 last year.

They attacked him using their fists, feet, and a variety of weapons including an electric drill, bats, machetes and a cane.

News that someone was shot dead at that residence last night was kept from the jury so their deliberations would not be affected.

But Puisne Judge Carlisle Greaves broke it to them after the final verdicts were delivered, saying: “During the time that you were sequestered, it’s understood that a homicide — I cannot say a murder yet, I do not have the right to say that — but a homicide has occurred.

“A shooting did occur at the Furbert house that was the subject matter of this case and a person has died. The Police I believe will give you further details as to how it happened but you may find that some of the details are eerily similar to some of the details that you have [heard] in this matter in the manner in which the assault was carried out.”

He reassured them that their safety was, and is, the paramount concern. He also told them Mr. Furbert was not the shooting victim, whose name has yet to be formally released by the Police.

Meanwhile there were angry scenes outside the courtroom as Mr. Douglas and Mr. Smith were arrested, handcuffed and taken to Hamilton Police Station to be questioned over the shooting.
