DAB rejects second retroactive application for St. David?s home
The Development Applications Board (DAB) has refused retroactive planning permission to two St. David?s developers for the second time.
The DAB refused Derek Wright and Calvin Richardson retroactive planning approval for revisions to two new homes on Lot No. 6, Tranquillity Lane, near Chapel of Ease church on February 15.
It said it refused the application, as received on October 11, 2005, because the homes were higher than the maximum permitted two stories in a Residential 2 development zone.
?The proposed massing and scale of the development along with the overall appearance and visual impact in the context of its surroundings will have an overall negative impact on the surrounding environment,? it said.
The two homes were approved on June 3, 2002, however, were not built to plan.
Mr. Wright and Mr. Richardson first sought retroactive approval on January 12, 2005, but were denied.
They appealed to the Environment Minister on March 3, 2005 but were dismissed on May 18, 2005.
An October 11, 2005 application sought to make the homes smaller by removing a garage and powder room, however, Planning?s technical officers decided on February 15, 2006, they still could not support the application.
?The structure is still three levels and the Department has significant concerns with the creation of a false level via topographical modifications,? it said.
?The proposal still does not satisfy the details of planning with respect to height, scale and massing.?
