Daniels guilty of using gun to resist arrest

After four hours of deliberation, a Supreme Court jury found a man guilty of multiple gun charges. The nine-man, three-woman jury convicted Allan William Daniels yesterday evening of using a firearm to resist arrest, possession of a firearm without a license and possession of ammunition without a licence.

The defendant, 28, of Brooklyn Lane, Pembroke denied the charges from the incident taking place around 7 a.m. on Court Street on February 12, 2004.

Daniels will be sentenced tomorrow. This was his second trial; Daniels was originally convicted last year of possession of ammunition and drugs and acquitted of attempted murder of Det. Con. Waren Bundy.

Late last year the Appeals court quashed both the firearms charge that Daniels pleaded guilty to and the one he was convicted of, saying he originally planned to plead not guilty to all counts, but was advised by lawyer John Perry Q.C to admit possession of a firearm.

They upheld the appeal against the firearms convictions, but rejected an appeal against the drug convictions and sentences.

Daniels claimed he just taken the gun off a young man who had told him he was going to attack a third man. He further told the jury: "I had the intentions of going to the Police station and resting it on the counter" and intended to hand over the gun to Police.

During cross-examination, Crown counsel Carrington Mahoney suggesting that he made up the entire story.

Mr. Mahoney told the jury that Daniels has told several versions of what happened that morning, but Daniels denied this. He said: "You have all the information, statements and interviews in front of you as do the jury and my counsel. Whatever story you chose to make up is entirely up to you. I'm here to tell the truth".

DC Bundy said when he ws confronted, Daniels tried to get away, but when tackled, pointed the gun in his abdomen and pulled the trigger three times causing "dry snaps". Det. Con. Bundy was backed up in court by three other officers.
