Police grilled over defendant's car key
Legal arguments took up much of yesterday's court session in the trial of alleged Court Street gunman Allan William Daniels.
Daniels denies trying to kill Det. Con. Warren Bundy when he allegedly pulled a Ruger 9 mm semi-automatic handgun on Court Street around 7 a.m. on February 12, 2004. Daniels, of Brooklyn Lane, Pembroke, is also accused of using a firearm to resist arrest, possessing ammunition without a licence, possessing cocaine and cannabis with the intent to supply and possessing drug paraphernalia.
Last Monday, Daniels pleaded guilty to possessing a firearm without a licence.
The whereabouts of the key to Daniels' BMW car took up much of the remaining time yesterday.
Det. Con. Don DeSilva told the court he did not receive the car key until shortly before Police searched the car on February 14.
He also told the court Police impounded Daniels car on February 13 after calling a locksmith because they did not have the key.
In the jailer's log there is a notation that a key was part of the items seized from Daniels upon his arrest on February 12.
On Monday, Det. Con. Llewelyn Edwards was also questioned about another entry in the jailer's log, which indicated that he and another Police officer received the defendant's keys on February 12.
To which Mr. Edwards replied: "Did I?" He went on to state he could not remember the event but if it was in the jailer's log then it must have happened.
A few minutes later Det. Con. Edwards answered a similar question about the key by stating: "No, that entry is incorrect at no point in time did I have possession of the defendant's keys." However, he changed his version of events regarding the defendant's keys after lunch when he said: "Those keys that were taken were his bike keys." John Perry QC asked Det. Con. DeSilva yesterday why Police didn't check to see if the car key was included in the defendant's seized items.
He told the court that in hindsight, Police thought to check the seized possessions and found the car key.
The trial resumes this morning before Puisne Judge Ian Kawaley in Supreme Court.
