Driver was over the limit
Devonshire man a one-year ban from driving all motor vehicles.
Victor O'Connor, who told Police "I should have stayed by my boat'' when they stopped him on December 15, was fined $350 and given the mandatory driving ban by Senior Magistrate Will Francis.
"You should follow your own advice,'' Mr. Francis told O'Connor. "And you were at far less than many of the people that I see. Nevertheless...'' O'Connor, 42, of Mary Victoria Road, pleaded not guilty to a charge of riding while impaired and guilty to having a proportion of alcohol in excess of 80 milligrammes per 100 millilitres of blood.
Crown counsel Larry Mussenden offered no evidence on the riding while impaired charge. He told Mr. Francis Police followed O'Connor at 12.55 a.m. on December 15 along Middle Road near the Perfume Factory in Hamilton Parish.
When the officers asked him for his driver's licence, they found his eyes were glazed and his speech was slurred. He later admitted he had drank two beers.
He was taken to Hamilton Police Station for the breath samples and found to have readings of 89 and 88 milligrammes per 100 millilitres of blood. The legal limit is 80 milligrammes of alcohol in 100 millilitres of blood.
