Conway Bennett, of Cobbs Hill Road, Warwick pleaded guilty to driving while intoxicated and to probable dangerous driving.

He was charged with probable dangerous driving because Police had not seen him driving, but found the keys in his hand -- putting him legally in charge of the vehicle.

Police on patrol in Warwick at 2.30 a.m. on December 12 responded to a report of a man lying in the street, said Prosecutor Sgt. Kenrick James.

They found Bennett on Middle Road lying on his back, partly across the road.

He was wearing a helmet, his motor cycle was on top of him, and the keys were in his hand, said Sgt. James.

He appeared to be sleeping, when Police attempted to lift him to his feet.

Sgt. James added that the Police had noticed he smelled strongly of drink.

Bennett began to speak incoherently when Police questioned him as to his identity.

"I thought I had made it home,'' he said.

Bennett refused to give samples of his breath for analysis, and he was arrested and taken to Hamilton Police Station.

He said he had been at a staff party, and asked for an exemption from any driving disqualification, as he had just joined the Regiment and needed transport.

"The Regiment can pick you up,'' retorted Acting Magistrate the Wor. Arthur Hodgson.

He imposed a fine of $400 and banned Bennett from all vehicles for one year.

He added that his son sometimes went to Flanagan's. "I'll tell him to look you up.''
