Magistrate fines motorcyclist

A man who'd enjoyed "two beers" at a Southampton restaurant got into a collision that landed him in court yesterday.

Marco De Ponte Carvalho, 26, pleaded guilty to impaired driving after a translator interpreted the charge into his native Portuguese tongue. Prosecutor Nicole Smith told the court that Police attended a collision on South Road in Southampton at 9.08 p.m on August 26.

Carvalho's Yamaha motorcycle and a blue livery cycle were on the side of the road, and the defendant was standing next to his bike, holding his shoulder.

According to Ms Smith, he'd been at the Tio Pepe restaurant just prior to the collision. He was travelling west when he attempted to overtake the other bike, which was travelling in the same direction, but collided into the back of it instead. The Police noticed that Carvalho, of Cedar Hill, Warwick, appeared to be drunk. Asked if he'd consumed alcohol, he replied: "Yes, I had two beers."

Senior Magistrate Archibald Warner fined him $1,000, banned him from driving for 12 months and meted out 12 demerit points. He also handed Carvalho a further $380 in fines and seven demerit points for offences racked up on different occasions speeding at 77 kph and driving without a license.
