Cox freed after appeal

Davaun Cox is led from Supreme Court during his trial last year. He will be freed following a successful appeal.

A man jailed for making overtures towards a young girl will be freed by the Supreme Court, following a successful appeal.

Davaun Cox, 29, is expected to be released from custody today.

He was jailed for three years on May 16, 2013, with two years’ probation added for the March, 2012 offence of intruding on the privacy of a girl.

However, Puisne Judge Stephen Hellman heard from defence lawyer Kamal Worrell that no formal guilty plea was ever taken by Magistrates’ Court.

Cox had initially denied the offence but opted to change his plea near the end of the trial.

Senior Magistrate Archibald Warner refused to accept a plea of guilty until Cox could get legal representation — but a guilty plea was mistakenly recorded.

Cox has been in held in custody since September, 2012.
