Arresting officers stick to their guns

Police officers who arrested the man accused of murdering mother-of-three Chena Trott told a Supreme Court jury yesterday that their accounts of the arrest were accurate and had not been embellished.

George ?Messy? MacDonald Liburd is accused of murdering Ms Trott, 33, at the Crawl Esso Tigermart in August, 2002.

He stabbed Ms Trott six times during the brutal attack and fought off anyone who attempted to stop him, eye witnesses told the five-man, seven-woman jury last week.

Liburd, 32, has pleaded not guilty to murder, but guilty to manslaughter with diminished responsibility. The plea means he accepts that he killed Ms Trott, but claims that, at the time of the killing, he suffered from an abnormality of the mind.

Last week, the court heard chilling testimony from Police witnesses, who said Liburd told them he would kill Ms Trott again if he had the opportunity.

Detective Constable Raoul Ming told the court that on Saturday, August 10, 2002, he went to a residence at 31 Dudley Hill to arrest Liburd on suspicion of murdering Ms Trott with several officers including Det. Sgt. Dennis Gordon and Det. Con. Ronald Green.

Det. Con. Ming said Liburd complied with instructions and was cautioned that he was being arrested for murder. ?We cautioned Mr. Liburd who replied, ?yeah I know?,? Det. Con. Ming said.

He said Det. Sgt. Gordon then asked Liburd what weapon he used to carry out the attack, to which the defendant replied ?I used a f***ing knife?.

Det. Con. Ming said Liburd then told Det. Con. Green: ?Green, look what we into now, that girl is a wicked bitch. I was in the same situation again I?d do it a f***ing again.?

Det. Con. Ming told the court Liburd went on to say: ?It would be best if you shoot me, look what we?re into now. That girl is a wicked bitch. I?ll go up and sit up there for life, or I?ll kill my f***ing self.?

On August 5, after one of Ms Trott?s daughters reported an incident of domestic violence between Liburd and Ms Trott, Liburd appeared to be mild and evenly mannered, said Det. Con. Ming said yesterday.

Queen?s Counsel John Perry asked the detective when he had made his Police statement.

Det. Con. Ming admitted to the court that he had not recorded a Police statement until October 2002 ? two and a half months after the incident.

Mr. Perry also suggested that Liburd did not use the word ?f**k? while answering Police questions. ?I suggest to you that he did not say a f***ing knife, he simply said a knife.?

?I had written what I thought I heard,? said Det. Con. Ming.

Last week, Det. Sgt. Barry Richards told the court that Liburd said in the aftermath of the killing; ?That girl is a wicked bitch. I?d f***ing do it again, that girl is a f***ing bitch, I?d f***ing go off and sit up there for life or I?d f***ing kill myself but but I?d f***ing do it again. When I loved we loved deep, that girl played a f***ing game on me, I?d f***ing do it again.?

Mr. Perry read portions of a Police statement in which Liburd was quoted as using the f**k word to Det. Con. Ming, however, he pointed out that he had been reading Det. Sgt. Richards? statement to Det. Con. Ming and not his statement.

Det. Con. Ming said he recorded only what he heard during the arrest.

Police testimony continued with retired Det. Sgt. Dennis Gordon, who gave his account of what happened when officers arrived at the residence in Paget to arrest Liburd.

He told the court that Liburd confirmed he used the knife that officers found on a bedroom floor in the residence to kill Ms Trott. Police later recovered a knife block from a residence on Fentons Drive in Pembroke which had a kitchen knife missing from one of the slots in the block.

?The defendant replies, ?yes, that?s the knife I killed Chena Trott with, that f***ing bitch, you know I did it?,? said Mr. Gordon.

Mr. Gordon said Liburd co-operated with Police Officers and went with them to retrieve the material he used to cover the knife.

Officers found the bloody sock on a rafter inside a bus shelter across from the Crawl Hill gas station where the killing took place. Liburd had pointed out the location when officers arrived at the area, Mr. Gordon told the court.

He also said Police asked Liburd if he wanted to be interviewed, however, he said: ?Gordon, right now I?m hungry and I?m tired and all I want to do is lie down. I have a lot on my head right now.?

Mr. Perry also suggested to Mr. Gordon that he brought up the name Yankee, a suggestion he denied.

A Police witness told the court last week that during questioning, Liburd said, ?I would kill Yankee, I should have killed Yankee, that f***ing rat.?

The court also heard last week that Ms Trott had a protection order put in place against Liburd on August 6, which prevented him from having any contact with his former girlfriend or her children for 28 days, a court order that he disobeyed.

The trial continues today before Puisne Judge Charles Etta Simmons.
