Impaired driver jailed following assault
A 56-year-old Smith?s man was jailed yesterday after he pleaded guilty to assaulting a Police officer after being pulled over on suspicion of driving while impaired.
Before any of the charges were read to Derek Leon David, of Ramgoat Hill, he interrupted to plead guilty.
?I don?t want to waste the court?s time,? David said. ?I did it all. I?m guilty.? David admitted that he was pulled over because he was wobbling on his motor bike and driving under the influence on Monday night. He also admitted to driving without a bike licence or third party insurance and that he assaulted the Police officer who stopped him and obstructed him from doing his duty.
Senior Magistrate Archibald Warner told David he also had outstanding 2004 fines for driving without a licence and insurance. David was sentenced to 30 days in prison for assaulting the officer and ordered to pay fines totalling $4,050 for the other offences or receive additional jail time.
But when Mr. Warner pointed out that David could serve the custodial time option concurrently with his assault sentence. David chose to save his money and spend 30 days at Westgate.
