Man was brutally beaten in city street, jury hears
A 32-year-old man was beaten and left unconscious in the street with a broken jaw, collapsed lung and bleeding to his brain, a Supreme Court jury heard.
The alleged assault on Damon Robinson was led by 27-year-old Jermaine Simmons, who has fled the Island, said Crown prosecutor Maria Sofianos.
Frederick Anthony Swann, 27, and Simmons' girlfriend, 29-year-old Carlena Caines, are now on trial for the alleged attack.
Swann is charged with causing Mr. Robinson grievous bodily harm last August 15. Caines is charged with being an accessory to the fact after a felony, and helping Simmons flee the scene and the Island.
The pair, both of Pembroke, deny the charges. Swann is represented by Larry Mussenden; Llewellyn Peniston represents Caines.
Mr. Robinson spent more than two weeks recovering in King Edward VII Memorial Hospital after the 2009 attack.
Ms Sofianos told the jury that on Saturday, August 15 at 5 a.m. Caines was bartending at Champions Sports Club on Reid Street.
Simmons and Swann were there.
"Something then happened which caused Simmons and Swann to rush after the victim as he walked down the stairs," Ms Sofianos said. "Video footage shows Simmons kicking the victim on the stairs. Caines knew what was happening but continued her work."
The jury was then shown CCTV footage of Mr. Robinson as he walked down the steps of Champions to Reid Street. The images show he was followed by Simmons and Swann.
Jurors were also able to see footage that appeared to show Simmons kicking Mr. Robinson.
"Swann and Simmons were seen punching and kicking the victim," said Ms Sofianos. "At this point, Damon Robinson was seen spitting up blood and Swann kicked him so hard he was knocked unconscious."
The prosecutor said Mr. Robinson was taken to hospital where it was discovered his jaw was broken in two places, he had a collapsed left lung, and bleeding and swelling to his brain. As a result, medical professionals induced a coma.
"On 5 p.m. that same day, Simmons left Bermuda on a US Airways flight to the US. Caines assisted in getting him that ticket as she was an employee of US Airways. Simmons' return ticket said September 1 but he hasn't returned."
Taxi driver Leroy Brangman was called as a Crown witness. He said he saw two men fighting as he dropped a passenger named 'Bisa' at the club. He described one man as wearing dark clothes, another in tan pants and white shoes. Both, he said, were "very small people".
He told Crown prosecutor Cindy Clarke he couldn't remember much more except "...it was a lot of cursing and carrying on. The one with the bottle was swinging first."
Mr. Brangman said it appeared the men were drunk and that he left when his fare came out of the club.
Bisa Saltus-Tate said she shared a home with Simmons and Caines who she called Nikita and other family members at the time of the alleged attack.
She told the court she stopped at Champions briefly on her way home.
Ms Saltus-Tate said she saw a light-skinned man with a mohawk come into the bar and exchange words with Caines which then prompted Simmons and Swann to go running after him.
She said Caines didn't try to stop the alleged fight.
The trial continues before Puisne Judge Charles-Etta Simmons.
