MURDER APPEAL DELAYED COA MUR Murder appeal delayed Convicted murderers Michael Dean Eberly and Michael Brian Pitcher had their appeals case adjourned this week.

Lawyers Saul Froomkin and Mark Pettingill advised the appellant judges that they are awaiting a Privy Council decision on a point of law pertinent to the Pitcher-Eberly case.

Crown counsel Peter Eccles is also involved with the two cases and noted that a decision is expected within two to four weeks.

The Appeals Court judges agreed to wait for the Privy Council decision before hearing the appeals against conviction and sentence.

The two men were sentenced to life imprisonment after being convicted of the brutal murder of 79-year-old Beatrice Simons in her Dockyard home back in 1997. Neither of the men admitted killing the elderly woman, each blaming the other for the crime.

The team working on the WHS application will meet with any and everyone and has already contacted East End churches, clubs and other community organisations to discuss the issues.

The team has also said it is willing to meet with individuals and their friends and neighbours who might prefer to hold such gatherings in their homes.

"Such a plan can only be created with the input of those who will chiefly be responsible for implementing it, the people and businesses who live and operate in St. George's,'' said Mayor Lois Perinchief.
