Widow arrested at hotel poolside
colony and arrested the widow of the president of the resort.
The case, between landowners Frascati Hotel Co., co-plaintiffs Cambridge Beaches and Mrs. Roberta Trott, heard how officers were summoned to the property. Mrs. Trott, who was around a swimming pool with friends, was arrested and later bailed.
Lawyer Georgia Marshall, acting for Mrs. Trott, told Puisne Judge Norma Wade Miller that her client had received a letter telling her not to venture onto land other than her home and its grounds.
She had shared the cottage with her husband, Cambridge Beaches president Thaddeus Trott, until his death in 1997.
Mrs. Marshall said due to a misunderstanding Mrs. Trott had not appeared in court and there was now a warrant outstanding. Mrs. Justice Wade Miller agreed to let them go before Magistrates today to rectify the situation.
Cambridge Beaches and Frascati are trying to gain possession of the cottage, All Spice, and claim damages of $224,856 -- which they say could have been made from letting the unit to hotel guests.
They claim the widow has no legal standing to object to the order and say she has refused to leave the property since being given notice to leave in February. Lawyer Christian Luthi also added that Mrs. Trott had not paid rent of $2,100 a month and although a tenancy agreement was drawn up, it was never signed.
Yesterday, Georgia Marshall said a meeting between Frascati and Mr. Trott, made reference to a lease that was to be drawn up, that would have given Roberta Trott the right to live in All Spice, following his death, for five years -- starting a year from his death.
Witness Ivan Davies, chief financial officer at Cambridge Beaches, confirmed that it would have been a directive issued to managing director Mike Winfield.
Earlier, she said the agreement was concluded orally before Mr. Trott's death, adding that his style of management meant he was in the habit of making decisions without approval or ratification from a third party.
Mrs. Marshall said documents would show that that was his manner and that such an agreement was in hand.
